Information on the processing of your data pursuant to Art. 13 GDPR
This is a convenience translation. In case of any discrepancy, the German Datenschutzerklärung is the legally binding version.
1. Controller
The controller responsible for data processing on this website is:
Genuja MBLange Straße 81
27804 Berne, Germany
Phone: +49 174 662 41 31
Email: info@mbgenuja.de
No data protection officer has been appointed, as the conditions of Art. 37 GDPR and section 38 BDSG are not met.
2. General principles
We process personal data only to the extent necessary to provide a functioning website and to handle your enquiries. Data is never passed to third parties for advertising purposes. This website uses no cookies, no tracking, no analytics services, no social media plugins and no externally hosted fonts or map services. No data is therefore transmitted to Google, Meta or comparable providers.
3. Hosting and server log files
This website is hosted by Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. The servers are located within the European Union. A data processing agreement pursuant to Art. 28 GDPR is in place with the provider.
When you access the website, the server automatically stores the following in log files:
- Anonymised or truncated IP address of the requesting device
- Date and time of access
- Name and URL of the file retrieved
- Volume of data transferred and notification of successful retrieval
- Browser type and operating system
- Referrer URL (the previously visited page)
Purpose: ensuring a trouble-free connection, comfortable use
of the site, and evaluation of system security and stability.
Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in the
technically error-free and secure operation of the website).
Retention: log files are generally deleted after no more than
30 days. They are not merged with other data sources and are not used to
identify you personally.
4. SSL/TLS encryption
For security reasons this website uses SSL/TLS encryption. You can recognise an encrypted connection by the “https://” prefix in your browser's address bar and the padlock symbol. When encryption is active, the data you transmit to us cannot be read by third parties.
5. Contact form
If you send us an enquiry via the contact form, we process the following data: name, email address and – where you provide them – phone number, postcode or location of the site, the service requested and the content of your message. For technical reasons your IP address at the time of submission is also transmitted, in order to detect misuse.
Purpose: handling your enquiry and preparing a quote.
Legal basis: Art. 6 (1) (b) GDPR (pre-contractual measures
taken at your request) and Art. 6 (1) (a) GDPR (your consent, given by ticking
the checkbox).
Retention: we store your enquiry until its purpose ceases to
apply, i.e. once the enquiry has been dealt with conclusively. If a contract is
concluded, statutory retention periods of up to 10 years apply
(section 147 AO, section 257 HGB).
Providing the data marked as mandatory is necessary for us to process your enquiry; without it we cannot prepare a quote. You may withdraw your consent at any time with effect for the future, for example by an informal email to info@mbgenuja.de.
6. Contact by email or telephone
If you contact us by email or telephone, your details are stored in order to process your request and in case of follow-up questions. The legal basis is Art. 6 (1) (b) GDPR where your enquiry relates to the performance of a contract or pre-contractual measures, and otherwise Art. 6 (1) (f) GDPR (legitimate interest in processing the enquiry).
Please note: unencrypted emails can be read by third parties in transit. For confidential information we recommend post or telephone.
7. Recipients of the data
Within our company, your data is only passed to those who need it to handle your enquiry. In addition, our hosting and email provider has access to the data as a processor under Art. 28 GDPR, where this is technically unavoidable. No transfer to third countries outside the EU/EEA takes place.
8. Your rights as a data subject
Under the GDPR you have the following rights:
- Access to the data stored about you (Art. 15 GDPR)
- Rectification of inaccurate data (Art. 16 GDPR)
- Erasure of your data (Art. 17 GDPR)
- Restriction of processing (Art. 18 GDPR)
- Data portability (Art. 20 GDPR)
- Objection to processing (Art. 21 GDPR)
- Withdrawal of consent with effect for the future (Art. 7 (3) GDPR)
An informal message to info@mbgenuja.de is sufficient to exercise these rights.
9. Right to lodge a complaint
Without prejudice to any other remedy, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of your residence, place of work or the place of the alleged infringement. A list of German supervisory authorities is available at bfdi.bund.de.
10. Currency of this policy
